BUSINESS IMMIGRATION

Categories of Business Visas

1. For certain individuals of extraordinary ability such as professors, artists, athletes, researchers, entrepreneurs, and multinational managers or executives and their beneficiaries

1.a Individuals of extraordinary ability: You may be eligible if you demonstrate  extraordinary ability in the sciences, arts, education, business, or athletics through  sustained national or international acclaim. You must be able to demonstrate you have  sustained national or international acclaim and that your achievements have been  recognized in your field of expertise; 

1.b You may be eligible if you are an Outstanding Professor or Researcher. You must demonstrate international recognition for your outstanding achievements in a  particular academic field. 

1.c You may be eligible if you have been recently employed by a U.S. employer  outside the United States in a Managerial or Executive Capacity for at least 1 year, and  this U.S. petitioner has been doing business for at least 1 year in the U.S. and intends to  employ you in a managerial or executive capacity.

2. For individuals with Advanced Degree or Exceptional Abilities

Certain individuals may obtain the US. Permanent Resident card (green card) without the  requirement of employment sponsorship and obtaining a job offer if they are in the field  of science, arts, business, entrepreneurialism, technology, culture, health, education,  engineering, math and/or are PhD holders. If the individual through his/her special ability is able to show a potential contribution to the United States and a track of success in their  field, they may be eligible to receive a green card. 

3. For skilled workers, other workers, professionals, and ministers

If you are a skilled worker, professional, or other worker, you may be eligible if you are:
  • “Skilled workers” are persons whose jobs require a minimum of 2 years training or experience, not of a temporary or seasonal nature. The skilled worker must meet the educational, training, or experience requirements of the job opportunity. Relevant  post-secondary education may be considered as training.
  • “Professionals” are persons whose job requires at least a U.S. baccalaureate or foreign equivalent degree and are a member of the professions.
  • The “other workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.

Ministers and non-ministers in religious vocations and occupations may also immigrate  to or adjust status in the U.S. for the purpose of performing religious work in a full-time  compensated position.
